TMC MLA Jailed For Two Years: A Trinamool Congress MLA was sentenced to two years imprisonment by a court on the charges of stealing railway scrap
On the charges of stealing the railway scrap in the year 1995, a Trinamool MLA was held guilty and was awarded two years rigorous imprisonment by a court.
According to the sources the Trinamool congress MLA from Raniganj in Burdwan district, Sohrab Ali was sentenced to two years imprisonment on Tuesday by a court in Asansol for stealing railway iron scraps in 1995.
In the same case case two others were also awarded with the same punishment along with a fine of Rs 5000 by Seventh Judicial Magistrate’s court of Asansol.
Though Ali was sentenced for two years the sentence has been stayed for three months on the appeal by his counsel Jagadindra Ganguly to enable the petitioner to move a higher court for regular bail. And hence Ali was granted bail on a guarantee of Rs 10,000.
Meanwhile Somnath Chatterjee, former Loksabha speaker said Ali will lose his MLA membership automatically as he is sentenced for two years but the counsel of Ali argued that he can remain as an MLA for three months as the sentence has been stayed for three months.
In July 2013 the Supreme Court observed in an order that a public representative (MLA or MP) can’t seek protection for three months under clause 8(4) of The Representation of the People Act once he is convicted in a case and given punishment of imprisonment for two years or more. High court lawyer Arunava Ghosh said the same will apply to Sohrab Ali as well.
Ali was one of the five persons who were charged by GRP based on a complaint filed by RPF for stealing railway property in 1995, which were later recovered from their residences. One of the accused had died during trial.
